1. About Dialbox SMS Messaging
Dialbox is a SaaS platform that provides AI-powered phone answering and business communication tools to small and medium-sized businesses across Canada and the United States. As part of these services, Dialbox enables businesses to send and receive SMS/text messages with their customers.
Message types include:
- Missed-call text-backs: When a customer calls a business and the call is missed, the platform can automatically send a text message acknowledging the missed call and offering to help.
- Appointment reminders: Businesses can send automated reminders for upcoming appointments.
- Customer service responses: Businesses respond to customer inquiries via text when a customer has initiated the conversation.
All SMS messaging through Dialbox is transactional or conversational in nature. Dialbox does not send promotional or marketing text messages to consumers. Dialbox does not use SMS for advertising, sweepstakes, or bulk promotional campaigns.
2. How Consent Is Obtained
Dialbox and its business subscribers obtain consumer consent for SMS messaging through the following methods:
2.1 Inbound-Initiated Contact
A customer initiates contact by calling a business that uses the Dialbox platform. When the business responds via SMS (for example, a missed-call text-back), the customer's inbound call constitutes prior express consent for the business to respond via text message regarding that interaction.
2.2 Direct Request
A customer directly requests to receive text messages during a phone call, in-person visit, or other direct interaction with the business. The business records this request and the customer's phone number in the Dialbox platform.
3. Required Disclosure Language
Dialbox mandates that all business subscribers display the following disclosure (or substantially similar language) on any form or webpage where consumer phone numbers are collected for SMS communication:
"By providing your phone number, you agree to receive SMS messages from [Business Name] powered by Dialbox. Message and data rates may apply. Message frequency varies. Reply STOP to opt out at any time. Reply HELP for help. View our Privacy Policy and Terms of Service."
Consent is not a condition of purchase. Consumers are never required to provide consent to receive text messages in order to buy goods or services from a business using Dialbox.
4. Platform Safeguards
Dialbox implements the following safeguards to ensure compliant SMS messaging:
- Opt-out footer: All outbound SMS messages include instructions for opting out (reply STOP).
- Platform-level opt-out enforcement: When a consumer replies STOP, the Dialbox platform immediately blocks all further messages to that phone number from that business. This enforcement happens at the platform level and cannot be overridden by the business subscriber.
- Prohibited list sources: Dialbox prohibits business subscribers from uploading purchased, rented, or scraped phone number lists. All contacts must be sourced from direct consumer interactions.
- Opt-in record retention: The platform maintains records of how and when consent was obtained for each phone number.
- Per-number consent tracking: Consent status is tracked individually for each phone number, ensuring that opt-out requests are honoured accurately.
Data Sharing Policy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Text messaging originator opt-in data and consent will not be shared with any third parties.
5. Consumer Rights
Consumers who receive SMS messages through the Dialbox platform have the following rights:
- Opt out at any time: Reply STOP to any message to immediately stop receiving text messages from that business.
- Get help: Reply HELP to any message for assistance and contact information.
- Contact support: Reach the Dialbox support team directly at support@dialbox.ca for any questions or concerns about text messaging.
- Immediate processing: Opt-out requests are processed immediately. Once you reply STOP, no further messages will be sent from that business.
Message and data rates may apply. Message frequency varies based on your interaction with the business. Carriers are not liable for delayed or undelivered messages. Contact your wireless provider for questions about your text or data plan.
